TERMS & CONDITIONS OF SERVICE

These Terms govern the use of nadpremium.com and purchases made through the website.

NAD*PREMIUM is dedicated to premium alcohol-free beverages.
BEYOND* is dedicated to selected alcoholic wines distinguished by origin, identity and winemaking excellence.

Both identities are curated by Jean Hick and operated by:

1. Scope and acceptance

These Terms apply to consumers and business customers purchasing products or using services through the website.

By submitting an order, the Customer confirms that the information provided is accurate and accepts these Terms, the Privacy Policy, Shipping Policy and Refund Policy.

Where mandatory consumer law provides greater protection, that law will prevail.

2. Products and product information

The website may offer:

  • alcohol-free beverages under NAD*PREMIUM;
  • alcoholic wines under BEYOND*.

The alcohol content, ingredients, allergens, origin, certification and other characteristics of each product are those stated on its label and product page.

The terms “0.0%,” “alcohol-free,” “low alcohol,” “organic,” “Halal” and similar claims apply only where expressly indicated for the individual product. Not every NAD*PREMIUM product is necessarily Halal-certified, and BEYOND* products contain alcohol unless clearly stated otherwise.

Product images and colours are illustrative. Vintages, packaging and minor presentation details may change where the essential characteristics and value of the product remain unaffected.

3. Customer eligibility and age restrictions

Customers must have the legal capacity to enter into a contract.

Orders containing BEYOND* alcoholic products may be placed only by persons who meet the minimum legal drinking age in both the country of purchase and the destination country.

Age verification may be requested during ordering, payment or delivery. Delivery may be refused where valid proof of age is unavailable. The Customer must not purchase alcoholic products for a minor.

4. Orders and contract formation

An order submitted through the website constitutes an offer to purchase.

An automated acknowledgement confirms receipt but does not necessarily constitute acceptance. The Sales Contract is formed when we issue an express order confirmation or dispatch confirmation. We may refuse or cancel an order before dispatch where reasonably necessary, including in cases of:

  • product unavailability;
  • manifest pricing or description errors;
  • failed payment;
  • suspected fraud or unlawful activity;
  • age or destination restrictions;
  • legal, customs or logistics impediments.

Any amount already paid for a cancelled order will be refunded.

5. Prices, taxes and import charges

Prices are displayed in euros or another available currency and include applicable taxes where expressly stated.

For international orders, the Recipient may be responsible for import VAT, customs duties, excise duties, clearance fees and other charges imposed by the destination country. Unless expressly offered as duties paid, these amounts are not included in the product or shipping price and must be paid by the Customer or Recipient.

Currency conversions shown on the website may be indicative. The final exchange rate may be determined by the payment provider or card issuer.

6. Payment

Available payment methods are displayed at checkout and may include payment cards, PayPal and bank transfer. Payments are processed by authorised payment providers through secure systems. We do not directly store complete payment-card credentials.

An order may remain suspended or be cancelled where payment is not authorised or received.

7. Shipping and delivery

Available destinations, shipping costs and estimated delivery periods are shown before the order is completed or confirmed separately.

Delivery periods are estimates unless expressly agreed as binding. Customs controls, age verification, weather events, carrier disruption, strikes, regulatory restrictions and other events outside our reasonable control may cause delays.

Alcoholic products can be shipped only where lawful and operationally available. Some destinations may require additional documentation, taxes or delivery procedures.

For consumer orders, risk normally passes when the Customer or an authorised recipient takes physical possession of the goods. For B2B transactions, risk and delivery terms may be governed by the written quotation, contract or applicable Incoterm.

The recipient must provide complete and accurate delivery details and cooperate with customs, couriers and age-verification procedures.

8. Inspection, damage and delivery problems

The Customer should inspect the parcel promptly upon delivery.

Visible damage, leakage, missing items or incorrect products should be reported as soon as reasonably possible, preferably with photographs of:

  • the external parcel;
  • the shipping label;
  • the internal packaging;
  • the affected products.

Failure to report immediately does not remove any mandatory statutory rights, but prompt notice helps us investigate the claim with the carrier.

The Customer should not discard damaged goods or packaging until instructed.

9. Consumer right of withdrawal

B2C Customers may generally withdraw from an eligible distance purchase within 14 days after receiving the goods, without giving a reason.

The withdrawal must be communicated clearly by email or through the contact form. After giving notice, the Customer must return the goods within the applicable legal period. The Customer normally bears the direct cost of return unless the goods are defective, incorrect, or we have agreed otherwise.

Returned products must be handled only as reasonably necessary to establish their nature and characteristics. A deduction may be made for diminished value caused by excessive handling.

The right of withdrawal may not apply to goods that are rapidly perishable, clearly personalised or otherwise excluded by applicable law. A bottle is not automatically excluded merely because it contains a beverage; the legal exception must genuinely apply. EU and UK distance-selling rules generally provide a 14-day cancellation period and regulate return costs, deductions and refund timing.

This section applies to consumers only and not to B2B purchases.

10. Refunds

Where withdrawal is valid, we will refund the eligible amount, including the cost of standard outbound delivery where legally required.

Additional costs arising from a premium or express delivery option are not refundable beyond the cost of the least expensive standard delivery offered. We may withhold the refund until the returned goods are received or the Customer provides evidence of dispatch, where permitted by law.

Refunds are issued through the original payment method unless otherwise agreed.

11. Cancellations before dispatch

A Customer may request cancellation before preparation or dispatch.

Cancellation is not guaranteed once sourcing, personalised preparation, export documentation, carrier booking or dispatch has begun.

Nothing in this section limits a consumer’s mandatory right of withdrawal.

For B2B or specially sourced orders, non-refundable costs and specific cancellation conditions may be stated in the quotation or order confirmation.

12. Conformity and legal guarantees

Products must correspond to their description, be of satisfactory quality and arrive in an appropriate condition, subject to their nature and normal variation.

Consumers retain all mandatory legal remedies for defective, damaged, incorrect or non-conforming goods. Within the EU, consumer goods are generally covered by a minimum two-year legal guarantee, subject to national rules.

We are not responsible for deterioration caused after delivery by improper storage, exposure to heat or cold, mishandling, failure to follow storage instructions or use beyond the recommended period.

Wine and other agricultural products may present natural variation between vintages, batches and bottles where this does not amount to a defect.

13. Permitted use and commercial conduct

Products may be purchased for personal consumption, gifting, professional evaluation or legitimate business use. No Customer may, without written authorisation:

  • represent itself as an authorised distributor, agent or partner of NAD*PREMIUM or BEYOND*;
  • reproduce our editorial content, images, trademarks or product presentations for commercial use;
  • use false identities, consumer accounts or misleading information to obtain B2B terms or evade purchase restrictions;
  • alter, relabel, counterfeit or misrepresent products;
  • use the website or supply relationships unlawfully.

B2B resale rights, territories and commercial conditions must be agreed separately in writing.

14. Intellectual property

The website, selection architecture, texts, product descriptions, sensory profiles, graphics, photographs, logos and trademarks are owned by or licensed to the operator. No content may be copied, adapted, republished or commercially exploited without prior written permission, except where allowed by law.

Producer trademarks and materials remain the property of their respective owners.

15. Liability and force majeure

Nothing in these Terms excludes or limits liability where exclusion is prohibited by law, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or mandatory consumer rights.

Subject to those limitations, we are not liable for indirect or unforeseeable loss, loss caused by incorrect information supplied by the Customer, or events outside our reasonable control.

For business customers, any additional limitation of liability may be included in the relevant quotation or commercial agreement.

16. Privacy

Personal data are processed in accordance with the Privacy Policy, UK GDPR, the EU General Data Protection Regulation where applicable, and other relevant data-protection legislation.

Payment, delivery, customs and age-verification data may be shared with providers where necessary to complete the transaction or comply with legal obligations.

17. Governing law and disputes

These Terms are governed by the laws of England and Wales.

For consumers, this choice does not remove any mandatory rights granted by the law of the country in which they habitually reside, where those rights apply.

Consumers may bring proceedings before any court competent under applicable consumer law. The courts of England and Wales will have jurisdiction in all other cases unless a different forum is required by mandatory law or agreed in writing.

B2B disputes are subject to the courts of England and Wales unless the relevant commercial agreement provides otherwise.

18. Changes to these Terms

We may update these Terms to reflect legal, operational or service changes.

The version applicable to an order is the version available when the order is placed, unless a change is required by law.
